Question by Joey O: Can teens drink alcoholic bevs that they made themselves?
Hi, im 16 and i tried making cherry wine from scratch, to great success i might add, for scientific purposes. At this point i would like to drink the wine, being as i made it.
Do i have the right to drink alcohol (that I made) without a parents consent? My alcohol, my choice i would think.
i just want to know my rights, thank you.

If your state says it is illegal for someone underage to drink..then it is illegal whether you make it or not.

You don’t have any rights to drink alcohol. You’re underage and it’s illegal for you to drink.
That would be like saying, “Since I grew the pot, I should be able to smoke it.” It just doesn’t make sense.

Legally,no but in all honesty what harm will a glass of wine do.
If you had a large vat and the hops and the barley and all the other ingredients you could make kegs of beer. Legal? No. Drunk is drunk. Cop/judge doesn’t care where it came from, the fact is that it is in your system. So, those are your rights. None. The whole idea behind not giving you the right to drink until you were an adult was because maybe you wanted to do something beneficial with those brain cells besides destroy them.

You did in fact allude to something which is correct — you are probably (34 states) allowed to drink alcohol with your parent’s consent.
However, without their consent, you probably (35 states) don’t have the right to drink alcohol. The other 15 states do not have a law prohibiting consumption, such as MA.
The trouble is the cherry wine you have was illegally made. That’s actually a federal law violation. You have to be 21 to ferment alcoholic beverages. You can acquire the ingredients at any age, but to use them for the purpose of making beer or wine you need to be 21.
Go look up the laws in your state, consumption may not be expressly prohibited. But your cherry wine was illegally made, and in fact, you broke federal law rather than the generally more lenient state law.

No, if it’s the law in your state that you can’t drink at that age you can’t. NO matter if you made it or not. If that was the catch then I am sure I would have done it when I was 16. Sorry buddy wait your turn!

Surprisingly, nowhere in federal law is it written that you must be 21 to drink. It actually says the government cannot stop you from drinking if you’re OVER 21. However, most states have enacted laws regarding age limits and alcohol… but again, even those are more lenient than you’d think. In most states, it’s illegal for you to BUY alcohol if you’re under 21 (but it’s legal to buy the ingredients), but often you’ll be able to drink it at home if, for example, your parents give it to you. You’ll have to read up on your state laws for more info.
Doing it without your parent’s consent is probably illegal, but hey, whoever has never done anything illegal raise your hand. That’s what I thought.
