Question by TuX: How long do I lose my license if its my first DUI?
I got a DUI last week and people are all telling me different things. Some are saying I will lose it for 5 years and others are saying only a year if its my first one. Whos right?
I live in California by the way.
And if it matters I am under 21 “19 years old” I would try and make excuses but I will be honest by saying I am a young alcoholic and im not proud of it either.

I don’t know about California, but my Grandson, in Missouri, just lost his for 30 days for a first DUI.
Having know several alcoholics in my lifetime, i will just say: “I hope you (and my Grandson) figure out soon, that booze is a poison that will destroy everything that you touch.”

There is a range. It depends on the judge and your lawyer. Hope you got a good one.
It depends on what state you live in, and even if it is your first offense, it also depends on what the offense was.
There are various penalties for DUI in various states. I’m sorry to hear of your addiction, I pray that one day you will overcome your drinking problem. Think about your future, if you are in trouble for drinking and driving now (being your first offense) it will not stop there. Your problem is just beginning. Next time could be worse – you are worried about losing your license, what about your life or the life of another? Get help. I know because I was a problem drinker nearly ten years ago. I made up my mind not to indulge any longer, because my life became a living hell. I lost control and then realized I was tired and needed help. I began to pray and ask God to help me overcome my addiction and today I am happy to say I am free from it. God can deliver you, if you let Him. My hope for you is genuine because I’ve been there. DMV Suspension periods for DUI arrests range from 30 days to up to three years and are as follows:
For Individuals under 21 years old arrested for a DUI
Under 21 years old with a 0.01 BAC or Higher and no prior DUI convictions or DMV DUI suspensions – 1 year suspension with the right to apply for a “Critical Need” license after 30 days. – Note DMV routinely denies the application for a “critical need to drive.” In order to better your chances, higher an experienced DMV attorney to submit the petition. Even a court ordered “critical need to drive” is not binding and will not automatically result in the granting a “critical need license.”
Under 21 years old with a 0.01 BAC or Higher and one or more prior DUI conviction or DUI DMV action – One year hard suspension with no eligibility for a restricted license or critical needs.

California First Offense DUI Penalties•Jail Time – A person who is granted probation and accepts the courts probationary period can face anywhere from no jail time up to 6 months in jail. Any jail time that is assigned is at the judge’s discretion. A person who is not granted probation will face between 96 hours up to 6 months in jail.
•Fines – The fines for a first offense DUI will be between $390 and $1,000
•Alcohol Treatment Program – A person convicted of a first time DUI offense who had a BAC reading under .20% will be required to attend a state-licensed and approved 30-hour alcohol and drug program. If a person’s BAC was above .20% they must attend a state-licensed and approved 60-hour alcohol and drug program.
•Driver’s License Info – The DMV will suspend a person’s driving privileges for 4 months if the person submitted to a breath, blood or urine test. This can be reduced to a 1-month suspension followed by 5 months of restricted driving privileges if the individual provides the DMV with proof of enrollment in DUI School. If the person refused to submit to testing, their license will be suspended for 1-year with no chance of gaining a restricted license. A person will be required to show proof of CA SR22 insurance in order to have their license reinstated.
California Second Offense DUI Penalties•Jail Time – A person facing a second California DUI offense within the past 10 years who is granted and accepts probation will receive one of the following jail sentences: 96 consecutive hours in jail, 10 days jail time or up to 1-year in jail. If the accused is not granted probation, the judge can sentence the defendant to 90 days or up to 1-year in jail. A number of counties will insist upon a minimum 10-day jail sentence.
